What Works for Your Family?
When you are negotiating custody and parent time (visitation), you may wish to try to come to an arrangement that is better than the statutory provisions. In most cases, it is best if the parents work together to determine what arrangement will be best for the child. If they are unable to reach an agreement, a judge will decide who gets primary custody and who gets visitation.
When parents work together to write a parenting plan that meets their family's needs, it is usually beneficial for everyone. Parents may get assistance from their attorneys, family law mediators or parenting experts to write the plan. The lawyers at Harward & Associates, LLC, have extensive experience with parenting plan creation. We work to help families write plans that make sense and are in the best interests of the child. Elements of Utah Custody Agreements
Custody and parent time in Utah are determined by what is in the best interests of the child. Factors the court may consider include:
- Which parent is likely to act in the child's best interests
- The bond of the child with each parent
- The conduct and moral character of each parent
Children may express their wishes regarding custody, but it is not the determining factor.
The parent(s) with legal custody will make decisions regarding health care, education and religion. Physical custody is the term for the parent with whom the children will live. Many parents who have joint legal custody do not have joint physical custody of the children, although that is one possible arrangement.
